By creating an account or using LETE, you agree to comply with and be bound by these Terms of Use. These Terms of Use provides users with an overview of the LETE Platform and detail the policies this platform is governed by. If you do not agree to these terms, please do not use our services.
The LETE Platform
By creating an account or using LETE, we agree to provide you with a platform that will allow you to not only record your health routines, but to also explore and share these routines freely between public groups and the rest of the world. The following is an overview of the features included on the LETE platform.
Your Health Portfolio:
- LETE’s primary feature is its home profile, which enables users to record and monitor their health and fitness routines, as well as track their progress over time. LETE encourages a healthy and active lifestyle by prominently displaying health activities in both calendar and historical formats. Additionally, users can enhance their fitness journey by creatively customizing their workouts and meal plans, making the process of cooking and exercising more engaging and enjoyable.
A Healthy Feed:
- LETE enhances user experience by integrating social media functionalities, enabling users to share their personalized health activities and explore those of others. The LETE platform features two distinct social media feeds: one dedicated to exercise-related activities and the other to nutrition-related content. This structure allows users to engage with content that aligns with their specific health interests and preferences.
The Power of Communities:
- Communities play a vital role in fostering support, motivation, and shared goals among individuals pursuing health and fitness objectives. LETE integrates community features by enabling users to join or create groups based on shared interests or health goals, enhancing interaction and engagement through group discussions and interaction. Gyms and cooking content creators can leverage this community aspect to boost member involvement, facilitate group workouts, and create a sense of belonging, with the hope this drives higher engagement and retention within their facilities.
Commitment to Health, Safety and Inclusivity:
- Safety is a primary focus of LETE, and we are committed to providing a secure and positive environment for all users. Our dedicated teams and robust systems actively monitor the platform to enforce community guidelines, address harmful behaviour, and ensure that interactions remain respectful and supportive. By implementing comprehensive safety measures and providing user support, we aim to create a safe and encouraging space for everyone to achieve their health goals. Improvement to the LETE platform:
- To enhance and refine the app’s features and provide a more personalized and effective experience, LETE may use the data and information gathered from user interactions. Additionally, this data may also be used to refine advertising strategies, ensuring that promotional content for brands and products is relevant and appealing to users based on their interests and activity patterns. By leveraging this information, we aim to continuously improve the app and deliver targeted advertising that adds value for both users and advertisers. Eligibility
At LETE, we are dedicated to fostering a safe and secure environment that complies with all applicable laws and regulations. To maintain the integrity of our platform and ensure a positive experience for all users, we require users to adhere to the following restrictions:
Who can access LETE:
- You must be at least the minimum legal age established in your country of residence, or at least 16 years old if no specific legal minimum age is prescribed.
- You must not have previously had an account disabled due to violations of our policies or legal requirements.
- You must not have any convictions for sex offenses.
- You must not be legally prohibited from accessing or using social media platforms.
Acceptable Use Policy
LETE has been designed to support users in achieving their goals through the effective use of the platform’s features. To ensure a secure and optimal experience, users are required to adhere to a set of established policies.
What Is Not Tolerated on LETE:
- Providing Inaccurate Information: Users must provide accurate and truthful information when creating an account. Deliberate misrepresentation of personal details or any other information is not tolerated.
- Impersonation or Sharing Confidential Information: Impersonating others or sharing confidential or private information about individuals without their consent is prohibited. This includes creating an account for someone else without their prior consent or unauthorized disclosure of personal data.
- Sharing Illegal Content: Posting or distributing content that is illegal, including sexually explicit material or any content that violates local laws and regulations, is strictly forbidden.
- Bullying/Harassing Users: Any material that can be perceived as bullying, intimidation, harassment will not be tolerated.
- Misuse of the LETE Services: Using the LETE services in ways other than their intended purpose is not allowed. This includes misusing the reporting and dispute resolution channels, spam/excessive posting, or any activities that deviate from the normal use of the platform as outlined in our guidelines.
- Violation of Community Guidelines: Any action that breaches the law, the policies above, or our Community Guidelines is not permitted.
Handling Inappropriate Behaviour
Along with creating a service that allows its users to become more motivated to achieve their health and fitness goals, LETE also prioritizes the safety and wellbeing of our users. The following outlines the functions and actions LETE.
Reporting and Moderation:
- To create a safe and respectful community for all users, LETE utilize comprehensive reporting tools that allow users to flag content or behaviour that violates our community standards. Our dedicated moderation team actively monitors the platform and reviews all reports to ensure swift and fair action, which may include content removal or account suspension. We reserve the right to monitor, review, and remove any user-generated content that we deem inappropriate or harmful, in our sole discretion. By implementing these measures, we aim to cultivate an environment where all users can engage positively and confidently.
Content Removal and Disabling or Terminating your Account:
- LETE reserves the right to monitor, review, and remove any user content that violates these Terms of Use, LETE’s Community Guidelines or if we are required to by law. Furthermore, LETE can refuse to continue providing you with the service (disabling or terminating your account) if at least 1 of the following situations occur:
- You violate LETE’s Terms of Use
- You violate LETE’s Community Guidelines
- If you/your content is deemed by LETE to create legal/regulatory exposure or risk for us.
- We are required to do so based on the law.
- We may take such actions without prior notice to you; however, we will notify you after we have taken action. If you believe that your account has incorrectly terminated, or you would like your account to permanently delete your account, please contact us immediately at support@leteapp.com.
Additional Rights and Disclaimers Retained by LETE:
The following outlines the additional rights retained by LETE, including its ability to manage, modify, and protect the platform. These disclaimers set the boundaries of LETE’s liability, clarify user responsibilities, and establish the platform's rights. Users should review this section carefully to understand their rights and obligations while using LETE.
- Content Rights: While you retain ownership of your content, you grant LETE a non-exclusive, royalty-free, worldwide license to use, display, reproduce, modify, and distribute your content. This right ends when either your content or your account is deleted.
- Modification and Termination: LETE reserves the right to modify or discontinue any aspect of the service at any time, with or without notice.
- LETE’s Intellectual Property: You cannot use our intellectual property, trademarks or similar marks, unless you have written permission from the LETE service.
- Limitation of Liability: To the fullest extent permitted by law, LETE, its affiliates, directors, officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of, or inability to use, the platform. This limitation applies regardless of the legal theory under which such damages are claimed, whether based on contract, tort (including negligence), strict liability, or otherwise, and even if LETE has been advised of the possibility of such damages. This limitation does not apply to liability arising from LETE’s gross negligence, wilful misconduct, fraud, or violations of applicable consumer protection laws that cannot be lawfully excluded.
- Liability within Force Majeure: In the event of any disruption (including cyberattacks), delay, or error that results in the platform being temporarily unavailable, LETE shall not be liable for any resulting losses or damages. However, LETE will make reasonable efforts to restore functionality as soon as practicable.
- Third Party Links: LETE may include links to third-party websites or services. We do not endorse or take responsibility for the content or practices of these third parties. Your interactions with third-party sites are at your own risk.
- Use of Music: By posting content on LETE, you acknowledge that you are solely responsible for that content, including any music you may include. LETE is not liable for any consequences that may arise from your use of music in your posts. Furthermore, you may not use music for commercial purposes unless you have obtained written permission or possess the appropriate licenses to do so. LETE also can remove any unauthorised content in line with these Terms of Use.
- Club Creation: All community pages on LETE must have unique names and are available on a first-come, first-served basis. As a user of LETE, you acknowledge that LETE does not reserve any specific club names and does not identify or pass on the information of a creator of a Club Page to any organisation. Creators are responsible for ensuring that their Club complies with all aspects of LETE’s Community Guidelines and Terms of Use, including that it doesn’t impersonate a club, and the LETE platform reserves the right to remove any Club or user that violate these terms.
- Changes to LETE’s Policies and Guidelines: LETE reserves the right to modify our Privacy Policy, Terms of Use, and Community Guidelines at any time. Users will be notified of any changes 30 days prior to their implementation via email, allowing ample time to review the updates. Continued use of the service after this 30-day notice period constitutes acceptance of the revised agreements, and users will be bound by the updated terms as specified. If you do not agree with any of the terms within the changes, you will be required to delete your account.
- Terms of Use: In the situation a part of this agreement (Terms of Use) cannot be enforced, the rest of the agreement will continue to be in effect.
Governing Law and Dispute Resolution:
By using the LETE platform, you acknowledge and agree that the laws of the country in which you reside shall govern these Terms of Use and any disputes arising therefrom. Any disputes related to the platform, or these Terms will be adjudicated in a competent court located in your country of residence. In instances where the jurisdiction is not applicable, such claims shall be brought before a competent court in Queensland, Australia. Furthermore, LETE reserves the right to initiate legal action against any individual in their country of residence for claims relating to unauthorized abuse, interference, or engagement with our products. By accepting these Terms, you consent to the jurisdiction and venue provisions outlined herein.
Definitions:
For the purposes of these Terms of Use, the following definitions apply:
- "User" or “you” refers to any individual who creates an account, accesses, or interacts with the LETE platform.
- "Content" includes but is not limited to text, images, videos, health activity data, workout routines, meal plans, and any other material uploaded, shared, or generated by users on the LETE platform.
- "Services" or “Platform” refers to all features, functionalities, software, applications, and offerings provided by LETE, including social media interactions, health and fitness tracking, and community engagement.
- "Personal Data" means any information that can directly or indirectly identify a user, including but not limited to name, email address, location, and health activity data, as further detailed in the Privacy Policy.
- "Intellectual Property" refers to trademarks, copyrights, patents, trade secrets, and any other proprietary rights owned by LETE, including the platform’s branding, software, and content.
- "Terms of Use" refers to this legally binding agreement between LETE and its users, governing access to and use of the LETE platform, including its features, services, and community interactions. By using LETE, users agree to abide by these Terms.
- "Community Guidelines" are the rules and standards governing user conduct on the platform, including acceptable content, prohibited activities, and enforcement measures.
- "Privacy Policy" refers to LETE’s policy governing the collection, use, sharing, and protection of user data, including personal information and health activity data. The Privacy Policy explains user rights regarding their data and is incorporated by reference into these Terms of Use.
- "Third-Party Services" refers to external platforms, applications, or providers integrated with LETE, such as fitness wearables, payment processors, and advertising partners.
- "Account Suspension/Termination" refers to LETE’s right to disable or permanently remove a user’s access to the platform due to violations of these Terms of Use, Community Guidelines, or legal requirements.
- "Law Enforcement Requests" refers to situations where LETE may be required to share user data with authorities in compliance with applicable laws and legal processes.
